​Terms and Conditions for the VISA® Prepaid Promotional Card Issued by Bankers Trust

Service Definitions

  • “Agreement” means these terms and conditions of the Visa Prepaid Promotional Card.
  • “Card” means the promotional Visa Prepaid Promotional Card, loaded with a specific amount of funds, redeemable to buy goods and services generally wherever Visa is accepted.
  • “Cardholder” refers to any person who uses the Card.
  • “We,” “us,” and “our” refer to Bankers Trust (“Bank”).
  • “You” and “your” refer to the person or persons who have received the Card and are authorized to use the Card as provided for in this Agreement.

This Agreement describes the terms and conditions under which the Card has been issued to you. By accepting and using the Card, you agree to be bound by the terms and conditions contained in this Agreement. Please sign your Card immediately and register online as the recipient of your Card. The Card will remain the property of the Bank and must be surrendered upon demand. The Card is nontransferable, and it may be canceled, repossessed, or revoked at any time without prior notice subject to applicable law.

Please read this Agreement carefully and keep it for future reference. 

Activation

You will need to activate your Card prior to using it. You can activate your Card online at www.consumercardaccess.com/btamerethanol or by calling toll free: 1-866-300-0319. You will be prompted to select a personal identification number (PIN) for the card at activation. If you prefer to use the card without a PIN, select “credit” at merchant terminals and sign the signature panel. To protect your card, sign the signature panel on the back of the card immediately after activating it.

Registration

To register go to www.consumercardaccess.com/btamerethanol. It is strongly recommended that you register as the recipient of your Card; otherwise you may not be able to establish that you are the owner of the Card if it is lost or stolen. Additionally, registering as the recipient of the Card will assist in determining FDIC deposit insurance coverage for the Card balance.

Fees

Card Replacement Fee: $10.00/card (for lost or stolen Card replacement).

Using Your Card

You may use your Card to obtain goods or services generally wherever the Card is honored. Generally, merchant terminals displaying the Visa, Plus, or SHAZAM network logos honor the Card. You will be prompted to request a personal identification number (PIN) for the Card, however, ATM and other cash withdrawals, and preauthorized payments are not permitted. You agree not to use your Card for illegal gambling or other illegal purposes. Display of a Visa card logo by, for example, an online merchant does not necessarily mean that transactions are lawful in all jurisdictions in which you may be located. If you use your Card number without presenting the Card (such as for mail order, telephone, or Internet purchases), the legal effect will be the same as if you used the Card itself.

You do not have the right to stop payment on any transaction made with your Card.

Each time you use your Card, you authorize us to deduct the amount of the transaction from the balance of the funds associated with the Card. YOU ARE NOT ALLOWED TO EXCEED THE BALANCE OF THE FUNDS AVAILABLE ON YOUR CARD. If you attempt to use the Card when there are insufficient funds available, the transaction will generally be declined. Nevertheless, if a transaction that exceeds the balance of the funds available on your Card occurs due to a system malfunction or otherwise, you shall remain fully liable to us for the amount that exceeds the available card balance.

If you wish to use your Card for a purchase that is greater than the balance of the funds available on your Card, you must tell the merchant to charge to the Card only the exact amount of funds available on the Card, and then you must arrange to pay the difference using another payment method. The merchant may require payment of the difference in cash rather than accepting another card, such as a credit or debit card. Some merchants may not accept these “split transactions.” If you fail to inform the merchant prior to completing the transaction, your Card is likely to be declined.

If you commence a purchase and then change your mind and fail to make the purchase after the merchant has already obtained an authorization for the transaction, the authorization may result in a temporary hold for that amount of funds for up to ten (10) days.
Certain Card authorizations may be declined due to: 1) the manner in which the merchant submits the authorization request; 2) the type of transaction submitted; and 3) the authorization amount exceeding the Card balance. Additionally, the merchant may require that the transaction be conducted in a manner different than how you initiated it. For example, you may attempt a PIN transaction and the merchant may require a signature transaction to complete the payment.

When using the Card at a restaurant, gratuity of up to 20% will be automatically added to the amount of the bill at the time of authorization through a credit card terminal. This ensures you have funds available to cover the bill plus gratuity. Additionally, the restaurant may also add an amount to your total bill (“padding”) at the time of authorization to cover any gratuity. However, your Card will only be charged the amount you indicate.

Restricted Transactions

Visa and Bank rules and regulations restrict the use of your Card from the following types of transactions:

  • Cash advance
  • Purchase of cash value products such as a money order or a cashier’s check
  • Exchange for foreign currency
  • Automatic Teller Machine (ATM) withdrawal
  • Wire transfer
  • Online gambling
  • Hotel and car rentals

Visa may change its rules at any time. Compliance with Visa rules is required.

Returns, Refunds, and Disputes

If you are entitled to a refund for any reason for goods or services obtained with your Card, you agree to accept credits to your Card for such refunds. It may take up to seven (7) days for the amount of the refund to be credited to your Card. You will need to contact the merchant to resolve disputes.

Receipts

You should obtain a receipt at the time you make a transaction using your Card. You agree to retain your receipts to verify your transactions. You may not receive receipts for small-dollar transactions of $15 and less.

No Warranty Regarding Goods or Services

We are not responsible for the quality, safety, legality, or any other aspect of any goods or services you purchase with your Card.

Lost or Stolen Card

Contact us AT ONCE if you believe your Card has been lost or stolen. You should call toll free 1-866-300-0319. Telephoning is the best way to minimize your potential losses. The Card may be replaced with certain restrictions: You must provide the Card number, and you must have registered as the recipient.

Additional Information about Your Card

It is important to track the balance remaining on your Card. You may determine the current balance on your Card by calling toll-free 1-866-300-0319 or by visiting www. consumercardaccess.com/btamerethanol. Your Card will expire after the end of the month shown on the front of your Card. After the expiration date, Card funds will expire and the Card will be closed.

Limitations on Our Liability

We will not be liable if:

  • you do not have enough funds available on your Card to complete a transaction;
  • a terminal or system is not working properly;
  • circumstances beyond our control (such as fire, flood or computer or communication failure) prevent the transaction;
  • a merchant refuses to accept your Card; and/or
  • access to your Card has been blocked after you reported your Card lost or stolen.

There may be other limitations on our liability.

Confidentiality

We may disclose information to third parties about your Card or the transactions you make:

  • where it is necessary for completing transactions;
  • in order to verify the existence and conditions of your Card for a third party, such as a merchant;
  • in order to comply with government agency, court order, or other legal reporting requirements;
  • if you give us permission; and/or
  • to our employees, auditors, affiliates, service providers, or attorneys as needed.

Other Terms

Your Card and your obligations under this Agreement may not be assigned. We may transfer our rights under this Agreement. Use of your Card is subject to all applicable rules and customs of any clearinghouse or other association involved in transactions. We do not waive our rights by delaying or failing to exercise them at any time. If any provision of this Agreement shall be determined to be invalid or unenforceable under any law or regulation, the enforceability of any other provision of this Agreement shall not be affected. This Card is issued by Bankers Trust under license from Visa U.S.A. Inc.

Cancellation

We may cancel or suspend your Card or this Agreement at any time. Termination of this Agreement will not affect any of our rights or your obligations arising under this Agreement prior to termination.

Governing Law

This Agreement will be governed by the laws and regulations of the state of Iowa except to the extent governed by federal law.
